Terms of Service
Last updated: 28 October 2026
The short version
- What it is. Gistify It is a desktop app. You give it a link, text, a PDF or images, pick a pattern, and AI writes a note into a folder you choose. Your folder is the permanent home of your notes. You must be 16 or over, and an account is for one person.
- Your content. You keep your rights. You must have the right to process what you give the app. We use it only to make the note you asked for.
- AI can be wrong. Check a note before you rely on it. Notes are not professional advice.
- Paying. Paid sizes renew every month, tax included. Stripe is the seller, so receipts, tax and refund requests go through Stripe. Monthly runs do not carry over, extra runs last 90 days, and a failed run is never charged.
- Leaving. You can delete your account at any time in Settings. We can close accounts that break these Terms.
- Your legal rights. Nothing here removes your rights under the Australian Consumer Law, or the mandatory consumer rights you have in the EU, the EEA or Switzerland. The law of New South Wales, Australia applies.
This is a guide. The full terms below are what count.
1. Who we are and how to reach us
Gistify It is run by Baker Tamory, a sole trader in Sydney, New South Wales, Australia. In these Terms, "we", "us" and "our" mean Baker Tamory, and "you" means the person using Gistify It.
For questions, complaints, privacy requests and legal notices, email support@gistify-it.ai. Our Discord community is for chat, not for legal notice.
These Terms are the agreement between you and us. Our Privacy Policy explains what we keep and why. When you buy something, Stripe's terms of sale also apply to that purchase (section 5).
2. Who can use Gistify It
- You must be 16 or over. If the law where you live sets a higher age for this kind of contract, you must meet that age too.
- An account is for one person. Do not share your sign-in. An account cannot be sold or transferred.
- You can use Gistify It for your work as well as for yourself. It has no team features.
- If we learn that you are under 16, we may close your account (section 11).
3. What Gistify It is
- The service. A desktop app for macOS and Windows 10 and 11. You give it a YouTube link, an article link, pasted text, a PDF of up to 20 pages, or up to five images, and pick a pattern: one of our curated sets of AI instructions. The app sends the run to our servers, an AI model writes the note, and the app saves it as a markdown file in the folder you chose, such as an Obsidian vault. Notion can import the same file.
- The AI provider. The AI model is run by a provider we choose. Today that is Microsoft's Azure OpenAI Service, Microsoft's enterprise AI service, which runs in Microsoft's own cloud and is separate from OpenAI's own services. The Privacy Policy explains how your content is protected.
- A refinery, not a store. Your folder is the permanent home of your notes. We do not host a vault, and we do not keep what you paste, link or upload. We keep a copy of each finished note for 120 days so you can recover a run and see it on your other computers (section 9). Do not treat that copy as a backup.
- Your own computer. For links, the app fetches the transcript or the article on your own computer, when you ask. That content goes to our servers and the AI provider only when you start a run.
- What we offer today. Patterns, features and screens change (section 10). We do not promise any feature that is not in the app.
- No affiliation. We are not connected to any person, company, channel, website or brand whose content you run, or whose approach a pattern describes. A pattern named after a consulting firm describes a way of working a problem. It does not mean that firm made, checked or endorses a note.
- Other people's apps. Obsidian, Notion, YouTube and similar services are not ours and have their own terms.
4. Your account and signing in
- You need an account to run a pattern. You sign in with Google or with an emailed six-digit code, and your account is created when you first sign in.
- Use an email address you can read, and keep your Google or email account secure. Tell us at support@gistify-it.ai if you think someone else is using your account. You are responsible for what happens under your account, unless someone got in because of a fault of ours.
- How you accept these Terms. Before you can sign in, you tick a box that reads "I agree to the Terms of Service and have read the Privacy Policy". If you are already signed in when these Terms first appear, you see a one-time dialog with the same box. When these Terms change materially, we ask everyone again (section 13). We keep each acceptance with the version of these Terms and the date.
- If you do not agree, do not use Gistify It.
5. Plans, runs, extra runs and payment
5.1 Sizes and runs
Gistify It comes in a free size and three paid sizes. Every size runs every pattern on the same model; the sizes differ only in how many runs you get each month. The allowance and price of each size are shown in the app before you choose one. One run is one finished note.
- We change allowances only with 30 days' notice.
- Monthly runs are use it or lose it. Runs left at the end of the month do not carry over, on any size.
- A failed run is never charged.
- Every note has a length limit. If a note reaches it and is cut off, it is not counted as a run, up to three times each month. From the fourth cut-off note in a month, a cut-off note counts as a run. The app tells you when a note was cut off and whether it counted; running the same source again will usually stop in the same place, so try a shorter part of it.
- When you reach zero, the app stops and offers extra runs or the next size up. Nothing is billed unless you choose it.
- We may refuse a run if you are out of runs, if another run on your account is already going (one at a time), if you send too many requests in a minute, or if the service is paused (section 10). A refused run is not charged.
5.2 Free
- Free needs no card and includes every pattern.
- Free runs are counted per computer as well as per account, so a second free account on the same computer shares the same free runs. To count them, the app makes a scrambled fingerprint of your computer that cannot be turned back into your computer's own identifiers (the Privacy Policy says more). Two people who share one computer share its free runs.
- The computer limit applies only to Free monthly runs, not to paid sizes or to extra runs.
5.3 Extra runs
- On a paid size you can buy extra runs in packs. The app shows each pack and its price before you pay.
- Extra runs last 90 days from the day you buy them, and the purchase screen says so before you pay. Runs not used within 90 days expire. They have no cash value and cannot be transferred.
- Monthly runs are spent first; extra runs are used only when the month's runs are gone.
- If you move down a size, extra runs keep working on any paid size. If you cancel to Free, they pause, and come back if you subscribe again before the 90 days end. The 90 days keep counting while they are paused.
5.4 Paying: Stripe is the seller
When you buy a paid size or extra runs, you buy from Stripe, not from us. Stripe is the seller of record (a "merchant of record"), through its Managed Payments service. In plain words:
- Stripe is the legal seller of your purchase, and takes your payment at its own checkout. We never see or store your card details.
- Stripe works out, collects and pays the tax that applies where you are (GST, VAT or sales tax). It is included in the price shown, so the price shown is the price you pay.
- Stripe sends your receipts, invoices and renewal reminders, and handles payment questions, disputes and refund requests under its terms of sale, shown at checkout.
- Checkout and receipts say "Sold through Link", Stripe's checkout brand, and your card statement shows LINK.COM* and our name.
- You can see your orders, change your card and cancel in Stripe's customer portal. The app links to it, and it is also at link.com.
We provide the service itself: the runs, the patterns and the app.
5.5 Renewals, changes and cancelling
- A paid size is billed monthly and renews on its renewal date until you cancel.
- You can cancel at any time in the customer portal. You keep your paid size until the end of the period you have paid for, then move to Free.
- Moving up a size takes effect at once: you pay the prorated difference at once, and runs already used stay used. Moving down takes effect at your next renewal, and the current month keeps the larger allowance.
- If a renewal payment fails, your paid access continues while Stripe retries. If the last retry fails, the subscription ends and the account moves to Free.
- If a subscription is fully refunded, or a dispute on it is lost, it ends at once and the account moves to Free. If extra runs are fully refunded, or a dispute on them is lost, their unused runs are removed. A partial refund does not change your access.
5.6 Refunds and cooling-off rights
Refund requests go through Stripe, under its terms of sale. Where the law gives you a right to cancel within a set time (in the EU, for example, 14 days for most online purchases), that right applies. For digital services supplied at once, that right can end when you start using what you bought, if you agree to that at checkout. These Terms never reduce a refund or remedy that the law gives you (section 12).
5.7 Changing prices
We may change our prices. A new price never applies to a period you have already paid for, and we will tell you before it applies to your next renewal, so you can cancel first.
6. Your content and your rights to it
What we mean. "Your content" is what you paste, link or upload, and the notes made from it.
You keep your rights. We do not claim ownership of your content or your notes. Between you and us, the notes are yours to use.
What we may do with it. You let us use your content for one purpose: to run the pattern you started. That means sending it to our servers and the AI provider, making the note, sending it back to you, and keeping a copy of the note for 120 days (section 9). We do not use your content to train AI models, and our AI provider does not either.
You must have the right. Only give Gistify It content you have the right to process this way:
- you made it, or you have the owner's permission, or the law and the source's own terms allow your use;
- it does not break anyone's copyright, privacy or confidentiality, or the terms of the site it came from (for example YouTube's terms);
- it is not confidential information of your employer or a client that you are not allowed to share with an AI service.
For links, the app fetches transcripts and articles on your own computer because you asked. You choose what to give it, so you are responsible for that choice. We do not check the content you give us.
Notes that quote people. A note can quote its source, including the names or handles of people who wrote in it. Those are other people's words, so check a note before you publish or share it.
What belongs to us. The app, the patterns (our AI instructions), the names and logos, and this website belong to us. We give you a personal, non-exclusive, non-transferable licence to install and use the app on your own computers while your account is open. Patterns stay on our servers: you get the notes they produce, not the instructions behind them. The app includes open-source software under its own licences.
7. AI output
- Notes are written by AI. A note can be wrong, incomplete, out of date or biased. It can get a quote wrong, credit the wrong person, or miss the point of the source. We design patterns to reduce this, but we cannot rule it out.
- Very long sources may be shortened on the way in, and every note has a length limit, so a note may leave out parts of the source or be cut off.
- A note is a summary or a framework made from a source. It is not the source, and it can miss detail and nuance.
- Check before you rely on it, most of all for decisions about health, money, law, safety or work.
- No professional advice. Notes are not legal, medical, financial, tax, investment or other professional advice. A pattern that works a business problem the way a consulting firm might is a thinking aid, not advice from us or from that firm.
- If a note looks harmful, wrong or inappropriate, use "Report this output" under the result, or email support@gistify-it.ai. We read every report, but cannot promise a reply time.
- The AI provider has safety filters. If a filter refuses your content, the run fails and is not charged.
8. Acceptable use
Do not:
- use Gistify It to break the law, or to make or share content that does, including content that harasses, threatens or defrauds anyone, or sexual content involving children;
- give it content you have no right to process (section 6);
- share your account, make extra free accounts, or use tricks (a patched app, virtual machines, scripts, another identity) to get more free runs or get round a limit;
- try to copy, extract or work out our patterns or how the service is built, or reverse engineer the app, except where the law lets you;
- send requests to our servers by any means other than the app, or use bots or scripts to run patterns;
- probe, overload, interfere with or try to break the security of the service;
- resell access to Gistify It.
If you break these rules, we may refuse runs, pause your account or close it (section 11).
9. What we keep, and for how long
Our Privacy Policy says what personal information we keep, why, for how long, and what choices you have. These Terms do not repeat it, and if the two ever differ about personal information, the Privacy Policy applies. Three points matter for how the service works:
- We do not keep what you paste, link or upload.
- We keep a copy of each finished note for 120 days, or until you delete it, so you can recover a run and see it on your other computers. After that it is deleted from our side. Your copy in your folder is yours and stays.
- We keep a record of how Gistify It is used. It never holds what you give the app or what your notes say. The Privacy Policy lists what it holds and how to switch part of it off.
Stripe keeps its own payment records as the seller.
10. Availability and changes to the service
- We aim to keep Gistify It working, but we do not promise it will always be available or free of errors. It depends on others: our hosting, the AI provider, Stripe, and sites such as YouTube, which can block or change how they work. When fetching from YouTube breaks, the app lets you paste the transcript yourself. A run needs an internet connection.
- To keep costs in check, the AI service has a monthly spending limit. If it is reached, Gistify It pauses for everyone for a short while: runs are refused, nothing is charged, and no run is used up.
- The app updates itself. We may change, add or remove patterns, features, screens, the AI model and the app, and the same pattern may give different notes over time.
- We change allowances only with 30 days' notice (section 5). If we remove something you have paid for, or end the service, we will give you reasonable notice and refund the unused part of your current paid period.
- We may stop supporting old versions of the app, or of macOS or Windows, with reasonable notice.
11. Ending an account
By you. You can stop using Gistify It at any time. To delete your account, open Settings, choose Delete account, and type your email to confirm. When you delete your account:
- any subscription is cancelled at once, with no automatic refund and no further charge;
- unused monthly runs and extra runs are lost;
- the notes we keep for you are deleted, while notes already saved in your folder stay, because they are your files;
- Stripe keeps its own receipts and tax records as the seller, which you can manage at link.com;
- we keep only anonymous, scrambled computer identifiers with their free-run counts, so deleting and remaking an account does not reset a computer's free runs;
- the record of how Gistify It is used is untied from you (the Privacy Policy says how);
- it cannot be undone. If you sign in again later, you start a new Free account with nothing carried over.
To stop paying without deleting your account, cancel in the customer portal (section 5.5).
By us. We may suspend or close an account if you break these Terms or the law, if your use puts other people or the service at risk, if there is payment fraud or abuse of chargebacks, if the law requires it, or if we stop offering Gistify It. Where we reasonably can, we will warn you first and tell you why. If we close your account for a reason other than your breach, we will refund the unused part of your current paid period.
After an account ends. Your right to use the app and the patterns ends. Sections that by their nature continue (your content, AI output, liability and governing law) continue. If you decline a new version of these Terms, you can stop using Gistify It and delete your account.
12. Liability
Your consumer rights come first. If you are a consumer in Australia, the Australian Consumer Law gives you guarantees about services that cannot be excluded. In plain words: we must provide the service with due care and skill, so that it is fit for the purpose we told you it is for, and within a reasonable time. For a major failure, you can cancel and get a refund for the unused part, or compensation for the drop in value. You are also entitled to compensation for any other reasonably foreseeable loss or damage caused by a failure. For a failure that is not major, you can have the problem fixed within a reasonable time and, if that does not happen, cancel and get a refund for the unused part.
Nothing in these Terms excludes, restricts or changes any guarantee, right or remedy that you have under the Australian Consumer Law or any other law and that cannot be excluded. If a part of these Terms would do that, that part does not apply to you.
EU, EEA and Swiss consumers. If you are a consumer in the EU, the EEA or Switzerland, you keep the mandatory consumer rights of the country where you live, including your rights if the service does not match what was promised. If these Terms give you less than those rights, those rights apply instead.
What we are not responsible for. To the extent the law allows, and without affecting the rights above, we are not liable for:
- loss from relying on AI output without checking it (section 7);
- loss from content you had no right to use (section 6);
- failures of things outside our control, such as your computer or internet, YouTube or another site blocking or changing, the AI provider, Stripe, or a power or network outage;
- files in your folder, which we do not hold and cannot restore;
- indirect or consequential loss, such as lost profit, lost opportunity or lost data, that we could not reasonably have foreseen.
A limit. To the extent the law allows, our total liability to you for anything connected with Gistify It is limited to the greater of what you paid for the service in the 12 months before the event that caused the claim, and A$100.
What is never limited. Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else the law says cannot be limited.
13. Changes to these terms
- These Terms are versioned. Each version has a date, and the current one is always on this page.
- For a small change (a typo, a clearer sentence, or anything that does not reduce your rights or add to what you pay or must do), we post the new version and it applies from the date shown.
- For a material change, we tell you before it takes effect, unless the law or security needs it sooner, and ask everyone to accept the new version with the same box as at sign-in. If you do not accept, you can stop using Gistify It and delete your account.
- A change never affects a purchase you have already made.
- We keep a record of each acceptance, with the version and the date, so we can show what you agreed to.
14. Governing law and disputes
- The law of New South Wales, Australia governs these Terms, subject to the mandatory consumer law of the place where you live.
- If something goes wrong, email support@gistify-it.ai first. We will try to sort it out with you within 30 days.
- The courts of New South Wales can hear a dispute between you and us. If you are a consumer in the EU, the EEA or Switzerland, you can also bring a claim in the courts where you live, and nothing here takes that away.
- Disputes about a payment itself are handled by Stripe under its terms of sale.
15. The small print
- These Terms and, for purchases, Stripe's terms of sale are the whole agreement about Gistify It.
- If a part of these Terms cannot be enforced, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- We may transfer these Terms and our rights under them to a company or successor that takes over Gistify It, and we will tell you if we do. You may not transfer your account or your rights.
- We give you notice by email to your account address or in the app. You give us notice at support@gistify-it.ai.
- The short version and the headings are a guide; the full terms control.
- We are not responsible for delay or failure caused by events beyond our reasonable control.
